This document sets out the terms and conditions that apply to the online booking system of Noover Pty Ltd ABN 57 664 215 865 (Noover) for customer bookings of car spaces at Noover Car Parks. These terms and conditions incorporate:
general conditions of entry to Noover Car Parks (which are displayed at the entry to each Noover Car Park); and
terms and conditions for any promotional or discount offers (which may be displayed at the entry to a Noover Car Park),
(collectively, “the Terms”). In these Terms, a “Noover Car Park” means a parking location in relation to which Noover’s online booking system may be used. These are set out at: https://www.sultanparking.com.au/.
2. Agreement
The Terms will be binding when:
you have completed and submitted an online booking form on Noover’s website
at https://noover.com, or the website of a relevant third party,
such as Devonport Airport: https://dpoairport.au/parking; and
Noover has accepted your booking by providing confirmation of your booking number and receipt of payment by email to the address provided when booking.
3. Changes to Terms
Noover reserves the right to change the Terms from time to time for future bookings and Noover recommends you read the Terms carefully at the time of every booking. If the Terms are amended, the updated Terms will be displayed on our website at https://noover.com.
Noover will not change the Terms for a booking that has been submitted by you. The Terms that will apply to your booking are the Terms that applied at the time you made your booking.
4. Online Booking System
Noover provides an online booking system accessible at https://noover.com by which you may book a car park space in an available Noover Car Park subject to these Terms. Where applicable, the booking system may also be available through the website of a relevant third party, such as Devonport Airport: https://dpoairport.au/parking.
Noover does not guarantee:
that the online booking system will be available at all times; and
the availability of specific car park spaces in Noover Car Parks when booking (certain car park spaces at Noover Car Parks may not be available at all times).
Noover reserves the right to limit the number of online bookings per person.
5. No resale
You agree that you will not attempt to resell or market any booking, whether on its own or bundled with other products or services.
Bookings may only be transferred between vehicles through the ‘manage my booking’ function on https://noover.com .
6. Price and payment
The price shown when you are making an online booking (the “Quoted Purchase Price”):
is in Australian dollars;
includes GST; and
includes credit card processing fees (if applicable and as notified by Noover to you prior to payment).
By completing and submitting an online booking form with your credit card details, you are authorising Noover to charge your credit card immediately with the Quoted Purchase Price.
Noover may, from time to time, offer discounted or promotional rates in respect of allocated car park spaces. To the extent any terms and conditions governing these discounts or promotions differ from these Terms, this will be advised at the time of booking, and any such differences will prevail over these Terms in the event of any inconsistency. All such discounts and promotions are subject to limited availability depending on availability of car park spaces, and Noover reserves the right to add or remove allocated car park spaces to or from the promotion, or to vary, amend or cancel promotional rates at any time for future bookings only.
Not all promotions available at Noover will be available via the online booking system. Conversely, some promotions may be exclusive to the online booking system.
7. Arrival and exit
Noover does not issue tickets for online bookings.
When you arrive at the Noover Car Park for which you have booked a space, you must use the car registered with the same licence plate you provided at the time of booking.
Vehicles must be parked within marked bays only.
When exiting the Car Park, the licence plate camera will automatically read your licence plate and let you out.
For an online booking for less than 4 hours, you may arrive up to one hour before your booked entry time. If you arrive any earlier than one hour before your booked entry time, you will be charged the drive-up rates for that Noover Car Park (noting that these rates may vary from the rates quoted via the online booking system) and you may not be entitled to a refund or credit on those charges.
For an online booking for more than 4 hours, you may arrive up to two hours before your booked entry time. If you arrive any earlier than two hours before your booked entry time, you will be charged the drive-up rates for that Noover Car Park (noting that these rates may vary from the rates quoted via the online booking system) and you may not be entitled to a refund or credit on those charges.
You may enter a Noover Car Park after your booked entry time, or exit a Noover Car Park before your booked exit time, without incurring any additional fees.
If you exit a Noover Car Park before your booked exit time (as confirmed by Noover via email), you will not be entitled to a refund or adjustment.
For an online booking for less than 4 hours, there is a one hour grace period for exit after your booked exit time. If you exit more than one hour after your booked exit time, you will be charged the drive-up rates for that Noover Car Park for the additional time in excess of the booked time (noting that these rates may vary from the rates quoted via the online booking system) and you may not be entitled to a refund or credit on those charges.
For an online booking for more than 4 hours, there is a two-hour grace period for exit after your booked exit time. If you exit more than two hours after your booked exit time, you will be charged the drive-up rates for that Car Park for the additional time in excess of the booked time (noting that these rates may vary from the rates quoted via the online booking system) and you may not be entitled to a refund or credit on those charges.
If you inadvertently park in the incorrect Noover Car Park, you will be charged the drive-up rates for that Noover Car Park and you may not be entitled to a refund or credit on those charges.
The online booking system only permits bookings for a maximum amount of 30 consecutive days (except for the Value Car Park, which has a maximum of 45 consecutive days).
You may only enter and exit a Noover Car Park once per booking period – if you exit a Noover Car Park and re-enter a Noover Car Park during a booking period, this will constitute a new booking and you will be charged at the drive-up rates for that Noover Car Park for the new booking (noting that these rates may vary from the rates quoted via the online booking system) and you may not be entitled to a refund or credit on those charges.
8. Large/heavy Vehicles
Noover only accepts cars and light vehicles that are able to fit within the dimensions of a standard car park (5.4m x 2.4m). Where height restrictions apply, Noover only accepts cars and light vehicles up to 2.2m high. Please contact Noover if you wish to make special arrangements to park a larger vehicle. If you make a booking and are unable to enter the Noover Car Park because your vehicle does not comply with our height restrictions, you may not be entitled to a refund of or credit on that booking.
9. Cancellations, amendments and refunds
You may amend or cancel (with a full refund) your booking up to 2 hours prior to your booked entry time. Where the purchase price for an amended booking period or product:
exceeds the purchase price for the original booking, you will be required to pay the difference between these amounts; or
is less than the purchase price for the original booking, you will be refunded the difference between these amounts.
If there is less than 2 hours until your booked entry time, the booking is non-refundable or you will not be able to make changes to your booking.
You may make online bookings up to 2 hours prior to your booked entry time.
If we need to cancel your booking because we are unable to supply the booking to you, and this is not due to your failure to comply with these Terms, we will use our best endeavours to find you a replacement car park location or provide you with a full refund.
10. No shows
If you make an online booking and do not make use of that booking, your payment for that booking will still be processed and you may not be entitled to a refund or credit on those charges unless cancellation is made in accordance with clause 9.
11. Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth), or any other applicable law that cannot be excluded, restricted or modified by agreement.
Noover gives no guarantee as to time taken to enter the Noover Car Park, or time taken to find a parking space in the Noover Car Park.
12. Your Responsibility regarding airline check in
Where the Noover Car Park is located at an airport, it is your responsibility to meet your airline’s check-in time and to allow sufficient time for unexpected delays including traffic congestion, limited Noover Car Park capacity, accident or delays.
13. Privacy
In order to process your booking, Noover requires personal information including; your name, postcode, suburb, vehicle registration number, phone number, email address and payment information (including credit card details). We also invite you to give us your flight details, but this is optional.
Our Noover Car Parks and associated areas are monitored by CCTV. These cameras are part of our general security and safety measures - they are not for the purpose of monitoring vehicles and any personal information that may be collected through CCTV is incidental and will only be used as permitted by law.
14. Governing law
The laws of Tasmania, Australia govern these Terms and each party irrevocably submits to the exclusive jurisdiction of that State.
